党的二十大报告强调:要推动企业数字化转型,以数字化赋能企业高质量发展,而建立专利防御是我国增强企业创新韧性,提升产业链与供应链韧性及安全水平的重要手段。研究发现,数字化转型显著促进了企业的专利丛林密度,助推了企业建立专利防御。在作用机制方面,数字化转型有助于提高企业研发能力,降低企业间信息不对称,完善企业外部知识产权保护环境,从而推动企业建立专利防御。异质性分析发现,企业类型分类中的劳动密集型企业与资本密集型企业,以及高科技行业类型分类中的化学原料和化学制品制造业、专用设备制造业、仪器仪表制造业与软件和信息技术服务业具有异质性特征。进一步分析揭示,区块链技术的数字化转型方式对企业建立专利防御具有更大的提升作用。验证了数字化转型对企业建立专利防御的推动作用,为我国数字化转型的政策制定以及企业制定专利战略决策提供了启示。
Abstract:The Report to the 20th National Congress of the Communist Party of China emphasizes the need to promote enterprise digital transformation and enable highquality development through digitalization. Establishing patent defenses serves as an important means to enhance the innovation resilience of enterprises and strengthen the resilience and security of industrial and supply chains in China. This study finds that digital transformation significantly increases the density of patent thickets and thereby promotes the formation of patent defenses. Regarding the mechanisms, digital transformation helps improve firms' R&D capabilities, reduce information asymmetry among enterprises, and enhance the external intellectual property protection environment, thus encouraging the establishment of patent defenses. Heterogeneity analysis shows varied effects across different types of enterprises and hightech sectors: laborintensive and capitalintensive enterprises exhibit distinct patterns, as do industries such as chemical raw materials and chemical products manufacturing, specialized equipment manufacturing, instrument manufacturing, and software and information technology services. Further analysis reveals that blockchainbased digital transformation exerts a stronger effect on building patent defenses.These findings confirm the role of digital transformation in advancing corporate patent defense strategies and offer insights for policymaking on digital transformation and for enterprises in designing patentrelated strategic decisions.
